1. Acceptance of terms
By downloading, installing, or using the OSPREY or KESTREL applications (the "Apps"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not download or use the Apps.
2. Description of service
OSPREY is a network diagnostics toolkit for iOS, providing tools such as ping, traceroute, DNS lookup, LAN scanning, port scanning, subnet calculation, SSL inspection, speed testing, iPerf3 throughput testing, and an AI assistant.
KESTREL is an SSH server management suite for iOS and macOS, providing an SSH terminal, live server dashboard, SFTP file manager, command library, service monitor, multi-server actions, SSH key manager, AI assistant, and optional end-to-end encrypted cloud sync.
3. License grant
Subject to these Terms, Michael Wright grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Apps on devices you own or control, for your own personal or internal business use.
You may not (a) sublicense, resell, lease, rent, or distribute the Apps; (b) remove or alter any proprietary notices; (c) use the Apps to build a competing product; or (d) attempt to derive source code from compiled binaries except to the extent permitted by applicable law.
4. Subscriptions & payments
- Paid tiers are available as monthly and annual auto-renewing subscriptions, and as a one-time Lifetime purchase.
- Monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period, in accordance with Apple's standard subscription policy.
- The Lifetime purchase is a one-time, non-refundable purchase that grants access to all current and future Pro features of the purchased App for the lifetime of the App.
- Prices are displayed in the App at the point of purchase and may change with reasonable advance notice. Existing subscribers will be notified of price changes via email or in-app notification, and given the opportunity to cancel before a price change takes effect.
- All purchases are processed by Apple via the App Store. To cancel a subscription, go to Settings → Apple ID → Subscriptions on your iPhone, iPad, or Mac.
- Refunds are handled by Apple under their standard refund policy. We do not process refunds directly. Requests can be made at reportaproblem.apple.com. This does not affect your non-waivable statutory rights under UK or EU consumer law.
- Free trials, where offered, convert to a paid subscription automatically unless cancelled at least 24 hours before the trial ends.
5. Acceptable use
You agree that you will not use the Apps to:
- Conduct unauthorised network scanning, port scanning, or intrusion attempts against networks or systems you do not own or have explicit written permission to probe.
- Reverse engineer, decompile, or disassemble the Apps, except where such activity is expressly permitted by applicable law.
- Use the AI assistant to generate content that is illegal, harmful, harassing, or that violates Anthropic's Acceptable Use Policy.
- Circumvent any technical measure intended to limit access to features.
- Use the Apps in a manner that violates any applicable law, including but not limited to the Computer Misuse Act 1990 (UK) or equivalent laws in your jurisdiction.
6. AI assistant terms
- The AI assistant features use Anthropic's Claude API. Output from the AI assistant is generated by a machine-learning model and may be incomplete, inaccurate, or misleading.
- AI output is provided as a suggestion only, not as professional advice. You are solely responsible for verifying AI-suggested commands, configurations, or code before executing or deploying them.
- You must not submit sensitive credentials (passwords, SSH private keys, API keys, personal data) to the AI assistant. The Apps make reasonable efforts to warn you, but responsibility ultimately rests with you.
- Use of the AI assistant also constitutes acceptance of Anthropic's Acceptable Use Policy and terms of service where applicable.
7. Network scanning disclaimer
OSPREY's scanning and probing tools (LAN scanner, port scanner, iPerf3 client, SSL inspector) may only be used against networks, hosts, and services that you (a) own, (b) administer, or (c) have explicit, documented permission to test. Unauthorised scanning of third-party infrastructure may be a criminal offence in your jurisdiction.
You acknowledge that you are solely responsible for ensuring you have authorisation to probe any target, and that Michael Wright is not liable for any misuse of the Apps' scanning capabilities.
8. SSH access disclaimer
KESTREL is a client application that allows you to connect to SSH servers you control. You are solely responsible for the security and configuration of your own servers, for the credentials you use, and for any actions performed via SSH. Michael Wright does not operate, monitor, or take responsibility for your servers or for commands executed within an SSH session.
9. Intellectual property
The Apps, including all code, graphics, trademarks, and design elements, are the intellectual property of Michael Wright and are protected by copyright and other laws. The names "OSPREY", "KESTREL", and the Engineer's Suite branding are trademarks of Michael Wright. All rights not expressly granted are reserved.
10. Disclaimer of warranties
The Apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except to the extent such warranties cannot be lawfully disclaimed under applicable consumer protection law in your jurisdiction.
11. Limitation of liability
To the maximum extent permitted by law, Michael Wright shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, business opportunity, or goodwill, arising out of or in connection with your use of the Apps, even if advised of the possibility of such damages.
Where liability cannot be excluded under applicable law, Michael Wright's total aggregate liability to you in any 12-month period is limited to the greater of (a) the amount you paid to Michael Wright for the Apps in that period, or (b) £100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under the laws of England and Wales.
12. Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in an EU Member State, you may also bring proceedings in the courts of your country of residence.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be announced in-app, and the effective date at the top of this page will be updated. Your continued use of the Apps after a change takes effect constitutes acceptance of the revised Terms.
